All employees injured by an accident or industrial disease arising out of, or in the course of their employment are legally entitled to compensation. The Workers Compensation Acts in each state and territory require employers to maintain compulsory “no fault” insurance to cover their legal liability.

When do you need to take out a policy?

Whilst there is a move towards national harmonisation of work health and safety laws, how workers compensation insurance is handled differs. Following is a brief summary for each:

ACT, WA, TAS, NT

Workers' compensation insurance provided by ‘approved’ insurers. Premiums are either set by insurers or are recommended by the relevant work health and safety authority, however, insurers have the ability to apply discretionary discounts or loadings.

VIC

Insurers are appointed as agents of the relevant work health and safety authority to manage employers’ workers compensation insurance policies and injured workers’ compensation claims. Premium rates are set by the authority.  

NSW

icare is the Government Insurer for workers' compensation in NSW workplaces and manages all workers' compensation policies directly.

SA, QLD

Workers compensation scheme managed directly by the relevant work health and safety authority.

If you engage any apprentices or trainees, or if you engage workers or contractors deemed to be workers and you pay, or expect to pay, more than $7,500 a year in wages

No threshold, if you employ workers then you must insure them within five days of commencing employment

All employers must register 14 days of employing workers, unless you pay your workers less than a set threshold ($14,920 in total for the 2023-24 financial year, indexed and adjusted annually)

If you are a first time employer, you have 60 days from the commencement of an employee to lodge an application for a policy with a WorkCover agent
